Official Rules for the 2017 Valentine’s Competition




1. BINDING AGREEMENT.  By ENTERING THE VALENTINE’S 2017 COMPETITION (“Competition”) outlined below, you are ENTERING AN electronic contract with THE Promoter to be bound by the Official Rules governing the Competition.  Therefore, please read the Official Rules FOUND BELOW carefully before ACCEPTING entry into the competition.tHePromoter encourages you to print and keep a copy of these Official Rules for your records.

2. PROMOTER.  The Competition is made available by PANDORA JEWELLERY SOUTH AFRICA (“Promoter”) located at Block 2, 4 Karen Street, Bryanston.

3. DURATION.  The Competition begins on 25 January 2018 at 08:00 am (+2 GMT) and ends on 18th February 2018 at 00:00 2018 (+2 GMT).

4. ELIGIBILITY.  The Competition is open only to persons of the minimum age of 18 years as of the date of entry who are in possession of a valid identity document, except  directors, members, partners, employees, agents or consultants of or any other person who directly or indirectly controls or is controlled by the promoter or marketing service providers in respect of the promotional competition, or the spouses, life partners, business partners or immediate family members, or anyone who within a period of 183 days preceding this competition has won any competition organised, promoted, or conducted by Pandora Jewellery South Africa, or who resides at the same address as such a winner, or who uses the same telephone number to enter this competition.


5. ENTRY.  An Entry is submitted by providing the Promoter with a potential participants full name, e-mail address and contact number on the Pandora Club enrollment form together with the till slip proving a purchase of over R1500 or making a purchase of over R 1500 online from the Pandora South Africa website.


Entries will not be returned or acknowledged. The Promoter reserves the right to verify the authenticity and accuracy of all information provided. 

6. ELECTRONIC COMMUNICATIONS.  By submitting an Entry to the Competition as described above, the participant agrees to do business with the Promoter electronically. By agreeing to do business electronically, a participant (i) consents to personal data being stored on Promoters servers, (ii) consent, subject to Promoter’s Privacy Policy and Rule 13 below, to the electronic communication and delivery via e-mail and post of all documents related to the Competition, (iii) agrees that the act of submitting an Entry to the Competition is a binding form of the participants electronic signature, which is binding in terms of the Official Rules. This consent is effective unless and until the participant withdraws it. The participant may withdraw consent to electronic communication and delivery of documents or update contact information at any time by contacting the Promoter at Pandora Jewellery South Africa, First Floor, Block 2, 4 Karen Street, Bryanston, Johannesburg. A confirmation notice will be sent once such requested change is processed.

7. WINNER SELECTION.  The Competition is a game of chance. There will be 1(one) winner in the entire competition. The Winner is selected on a lucky draw basis from all eligible entries submitted within the closing term of the competition day in question. The Winner will be selected after the closing date of the competition. The Winner will be notified by telephone or e-mail, and asked to confirm their details. Failure to respond to prize notification by a potential winner within seven (7) days of the Promoter notifying the potential winner by email will result in forfeiture of the applicable prize. If the potential winner cannot be reached on the telephone number or email address provided within the 7-day period they will be disqualified and a new potential winner may be selected at the discretion of the Promoter.  Any prize awarded may be forfeited if a prize winner fails to comply with these Official Rules.

8. PRIZES. There will be 1(one) prize throughout the duration of the competition. The prize with an estimated value of R50 000.00, will consist of an all-inclusive holiday for two people, including accommodation, flights and food for three nights, of which two nights are at the Marataba Lodge and one night at the Marataba Lodge Treehouse as set out here below. The prize is redeemable from for travel between 1st May and 31st August 2018. Additionally, Jewellery to the value of an estimated amount of R10 000.00 from Pandora forms part of the prize.  Prizes are non-transferable, may not be substituted by the prize winner, and are not redeemable for cash and no case alternative is offered.  All additional taxes, fees, duties, surcharges, if any, associated with the redemption of the prize are the responsibility of the prize winner. The Promoter reserves the right to substitute a prize of equal or greater value for any reason. All prizes will be dispatched to the winner no later than 18th March 2018.

9. INTELLECTUAL PROPERTY RIGHTS. By submitting his or her entry a participant assigns to The Promoter all intellectual property rights, including but not limited to any copyright, in any entry submitted by the participant for the Promoter to hold. The Promoter may use or not use, for any purpose, on any media, in whole or in part, in its original or amended form any entry submitted by the participant. By submitting his or her entry, a participant also waives his or her moral rights in the entry including the right to be credited as the author and the right to object to derogatory treatment of the work. This waiver is only effective in jurisdictions where it is possible to waive such rights. The User warrants and represents to the Promoter that the entry is in fact the User’s own entry, and that the commercial or non-commercial use of the quote will not infringe the Intellectual Property Rights of any third parties.



10. DISCLAIMERS.  The Promoter assumes no responsibility and is not liable for entries that are late, delayed, misdirected, illegible, or incomplete, and the Promoter assumes no responsibility and is not liable for system errors and failures, mechanical equipment malfunctions, viruses, hacker attacks, faulty transmissions, or other telecommunications malfunctions. Proof of transmissions does not constitute proof of entry.  By entering the Competition, each participant agrees to be bound by these Official Rules and the decisions of Promoter.


11. PRIVACY.  The Promoter respects your privacy. Personal data of participants are gathered and processed in accordance with the applicable data protection laws. By submitting an entry into the Competition, a participant is registering to receive electronic communications from the Promoter relating to the Competition.  When the prizes have been sent to the prize winners, the participant’s personal data is deleted.


12. RIGHT TO CANCEL OR TERMINATE.  If, for any reason outside the control of the Promoter, the Competition is not capable of running as planned, including because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, corruption, hacker attacks, faulty transmissions, force majeure, or any other cause beyond the control of the Promoter which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right at its sole discretion to cancel, terminate, modify or suspend the Competition.  If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

13. PERMISSION TO USE NAME/LIKENESS.  Any potential winner, by submitting an entry, grants permission to the Promoter to use his or her name and place of residence and likeness by manner of conducting the Competition including announcing the winners on a post by the Promoter on and and social media and including contacting the winner for prize notification and address confirmation purposes. The Promoter reserves the right but may choose not to do so, and the winner may decline such use.

14. RELEASE OF LIABILITY.  Each participant, by entering the Competition, and the winner, by accepting any prize, release the Promoter and the Promoter's affiliates, distributors and dealers, and their agencies, directors, officers, agents and employees from any and all liability, claims or actions of any kind whatsoever for any damage, loss or injury (excluding death or personal injury caused by negligence on the part of the Promoter) resulting from or arising out of participation in the Competition, and, as to the winner, the acceptance, use, misuse, possession, loss or misdirection of the prizes.

15. CONDUCT.  By participating, you agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification or ineligibility to receive a prize. You further agree to comply with and be bound by decisions of the Promoter, which shall be final in all respects. The Promoter reserves the right at its sole reasonable discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the operation of the Competition and/or the Competition Page; (b) violating these Official Rules; (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
16. DISCLAIMER.  THE PRIZES WILL BE AWARDED AS IS FULLY PERMISSIBLE UNDER LAW. THE PROMOTER DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE PRIZES. However, nothing in these Rules shall affect your statutory rights including in relation to any PANDORA product received as a prize.

17. GOVERNING LAW AND VENUE.   The Competition is governed in terms of the South African Consumer Protection Act 68 of 2008. All actions of the Promoter as well as the resultant provisions are done in terms of the abovementioned Act and thus all of the provisions of said Act apply.  Any disputes shall be referred to the Consumer Goods and Services Ombud for resolution if they cannot be resolved between the parties.
